Terms of Service

To use the Service, you must:

• Be at least 18 years of age.
• Be legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• Not be barred from receiving services under applicable Indian law.
• Provide accurate and complete information when creating your account.

If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Rezup provides an AI-powered resume builder and ATS (Applicant Tracking System) optimisation platform, including:

• Resume creation, editing, and management with multiple templates.
• ATS scoring: a rule-based algorithmic score of your resume across format, content, keywords, and readability.
• AI-powered features: bullet point improvement, resume import/parsing, job description tailoring, and skill gap analysis — powered by our AI infrastructure.
• PDF export of your resume.
• Anonymous ATS check on the home page (no account required).
• Pro plan: unlimited AI credits, watermark-free PDF, DOCX export, and portfolio page.

• AI features consume AI credits (1 credit per operation). Credits are deducted upon successful completion of an AI operation.
• AI-generated suggestions (improved bullets, tailoring suggestions, skill gap analysis) are suggestions only. You retain full responsibility for reviewing and approving any changes to your resume.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific job application or employer.
• You must not submit false, fabricated, or misleading information in your resume. AI suggestions that you accept and include in your resume remain your responsibility.
• We do not use your resume content to train our AI models.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable Indian law.
• Upload malicious files, viruses, or any code designed to disrupt, damage, or gain unauthorised access to systems.
• Attempt to reverse-engineer, scrape, or copy the Service, its algorithms, or its underlying AI models.
• Create multiple accounts to circumvent credit or plan limits.
• Resell or sublicense access to the Service.
• Use automated scripts, bots, or scrapers against the Service.
• Upload resume content containing hate speech, threats, or illegal material.
• Attempt to circumvent, disable, or interfere with security features of the Service.
• Misrepresent your identity or impersonate any person.
• Submit grossly false or fabricated work history with intent to deceive employers (you bear sole liability for misrepresentation to third parties).

Violation of this policy may result in immediate suspension or termination of your account without notice or refund.

All rights in the Service — including the website, product design, templates, AI models, scoring algorithms, code, brand, and logo — are owned by Rezup and protected under the Copyright Act, 1957 and applicable Indian intellectual property law.

Nothing in these Terms transfers any IP rights to you. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written consent.

To the maximum extent permitted by applicable Indian law, Rezup and its affiliates, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your reliance on AI-generated content.
• Damages arising from unauthorised access to your account due to your failure to maintain credential security.
• Any third-party actions, including employer decisions based on your resume.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 3 months immediately preceding the event giving rise to the claim, or ₹500, whichever is higher.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

You agree to indemnify, defend, and hold harmless Rezup and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service in violation of these Terms.
• Your User Content, including any claim that it infringes a third party's rights.
• Any misrepresentation you make to a prospective employer through resume content generated or edited using the Service.
• Your violation of any applicable law.

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes, claims, or controversies arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [City], India.

Before initiating any legal proceedings, you agree to first attempt to resolve disputes informally by contacting us at support@rezup.in. We will attempt to resolve the dispute within 30 days.

If informal resolution fails, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996 (as amended), with the seat of arbitration at [City], India and proceedings conducted in English.

This does not limit your rights as a consumer under the Consumer Protection Act, 2019, including the right to approach a Consumer Disputes Redressal Commission.

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email to your registered address before the change takes effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree, you must stop using the Service and delete your account before the effective date.

• Entire agreement: These Terms (and our Privacy Policy) constitute the entire agreement between you and Rezup regarding the Service and supersede all prior agreements.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
• No waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor entity.
• Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service failures.
• Language: These Terms are in English. In case of any conflict with a translated version, the English version shall prevail.
